    • Safe Harbor: Defines diligence steps for eligibility, requiring agencies to check SAMHSA’s online locator and HIPAA Notices to confirm a provider's Part 2 status before requesting records.
    • Segregation of Part 2 Data: States that segregating/segmenting Part 2 records is not required.
    • Complaints: Establishes the right to file complaints directly with the Secretary for Part 2 violations, concurrent with filing through a Part 2 program.
    • SUD Counseling Notes: Defines notes separately maintained by an SUD clinician that analyze sessions, requiring specific consent, akin to HIPAA protections for psychotherapy notes.
    • Patient Consent: Requires separate consents for records use in legal proceedings and prohibits combining these with other consents. Each disclosure with consent must include a copy of the consent or its scope.
  • Implications for Providers and Patients: How these changes will impact SUD treatment programs, healthcare providers, and patients.
  • Compliance Timeline: Key dates and steps for ensuring compliance with the new regulations by February 2026.
